Can I use copyright to protect my startup logo?

An interesting question and one that I will address now.

The short answer is a very conditional YES.

Why conditional?

Well you can only rely on #copyright protection if your logo could be viewed as an artistic creation; under section 4 of the Copyright Designs and Patens Act 1988, #artistic works are protected as works of copyright.

So does this mean that you don’t need to go to the expense of a #trademark application given that copyright requires no registration? The answer is NO.

A trade mark once registered will give you a far stronger right of action against a third party who tries to use your #logo without your consent.

Why?

Well with copyright you will have to show there is a causal connection between your copyright work and the infringing work (which can be tricky to prove); whereas with a trade mark; evidence of registration alone is usually enough to make infringing parties think twice before using your logo as ‘inspiration’ for their own!
